Request for independent investigation into Armier illegal development

Dr Matthew Agius, executive member of Momentum , has formally requested the Commissioner for Environment and Planning within the Office of the Ombudsman to open an independent investigation into the handling of the illegal development at Armier, including possible failures in planning enforcement, protection of public land, and coordination between public authorities.

The request concerns the construction of a structure on public coastal land adjacent to a protected Natura 2000 site, which was reported at an early stage by the Malta Ranger Unit and members of the public. Following these reports, the Planning Authority issued Enforcement Notice EC/00071/26.

However, despite the enforcement action, construction continued for a period of time, leading to widespread public concern and media scrutiny. Partial dismantling of the structure began on 16 June 2026, but subsequent inspections by environmental rangers in July revealed that demolition works had stopped after only one day, leaving the structure substantially intact.

The request asks the Commissioner to examine whether the relevant authorities acted with the necessary urgency and whether all available legal powers were properly used to safeguard public land and ensure full restoration of the site.

Among the issues raised are:

• whether the Planning Authority acted promptly after receiving the first reports of illegal works;
• whether enforcement mechanisms and direct action powers were fully considered and utilised;
• why the structure was not completely removed once dismantling works ceased;
• whether there was adequate coordination between the Planning Authority and the Lands Authority;
• whether accumulated daily penalties under the enforcement notice are being properly issued and collected;
• whether the matter was formally referred to the Malta Police Force for possible criminal investigation relating to the unlawful occupation and alteration of public land.

Dr Agius said, “The Armier case raises serious questions about the ability of public institutions to protect public land and enforce planning laws when faced with deliberate illegal development. An independent investigation is necessary to establish whether existing procedures were followed, whether there were administrative shortcomings, and whether lessons need to be learned to prevent similar cases in the future.”
